BY ENTERING THE SWEEPSTAKES YOU AGREE TO THESE OFFICIAL RULES (the “Official Rules”), WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING.

Introduction

During the period beginning on Friday, November 15, 2024 at 9:00 a.m. Eastern Time (“ET”) and concluding on Sunday, December 15, 2024 at 11:59 p.m. ET (“Sweepstakes Period”), FAIRWINDS Credit Union (“Sponsor”) will sponsor the Debit CardSweepstakes (“Sweepstakes”).

Eligibility

The Sweepstakes is open to legal U.S. residents, who are at least 18 years of age at the time of Sweepstakes entry. Proof of eligibility will be required to claim prize(s). The following individuals, regardless of their ability to meet the above qualifications, do not qualify to enter or win the Sweepstakes: employees of Sponsor, immediate family members (spouses, parents, siblings, children, grandparents, grandchildren) of employees of Sponsor, persons living in the same household of employees of Sponsor, Sponsor’s Board of Directors, and immediate family members (spouses, parents, siblings, children, grandparents, grandchildren) and/or persons living in the same household of members of Sponsor’s Board of Directors.

Sweepstakes Event Period

The Sweepstakes begins on Friday, November 15, 2024 at 9:00 a.m. ET and ends on Sunday, December 15, 2024 at 11:59 p.m. ET.

Prizes

Four (4) Sweepstakes Winners will be selected from all eligible entries to each receive an Apple Series 10 Watch. Each winner will visit the FAIRWINDS Credit Union Corporate Tower (135 W. Central Blvd., Orlando, FL 32801) or another agreed upon FAIRWINDS location and will claim an Apple Series 10 Watch. Prize value is estimated at $399.00. Value of prizes are subject to change at any time at the sole discretion of Sponsor. Prize must be claimed in person at the FAIRWINDS Credit Union Corporate Tower, 135 W. Central Blvd., Suite 200, Orlando, FL 32801 or another agreed upon FAIRWINDS location, or via mail within 15 calendar days of winner being notified and announced. Proof of identification by valid government-issued photo ID is required to claim prize. Failure of winner to claim prize within 15 calendar days of being notified will result in forfeiture of the prize. In the event that Winner does not claim prize, forfeits rights to prize, or does not meet eligibility requirements, it is the right of the Sponsor to select another Winner. Failure of winner to timely visit FAIRWINDS Credit Union’s corporate office or branch in person and sign and return any required affidavits and releases, or to claim a prize or comply with any term or conditions of these Official Rules, will result in winner’s disqualification and the forfeiture of his or her prize. Winner may waive right to receive prize. Prize is non-assignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability. Odds of winning depend on the total number of eligible entries received.

How to Enter

There are two (2) methods of entry: (1) Use your FAIRWINDS Visa Debit Card a minimum of 20 times during the sweepstakes period; and (2) Alternative Method of Entry (“AMOE”) outlined below. Each entrant may submit (1) entry during the Sweepstakes Period. AMOE entries have an equal chance of winning. No purchase or payment is necessary to participate in the Sweepstakes.

• Alternative Method of Entry: To avoid entering via the debit card usage method of entry, entrants may enter by the AMOE instead.

  • Send a handwritten 3” x 5” card with your first name, last name, residential address, daytime telephone number, and email address to: FAIRWINDS Credit Union Debit Card Sweepstakes 135 W. Central Blvd. #200 Orlando, FL 32801

If an AMOE entry does not provide all the above information, such entry will be deemed ineligible, as determined in Sponsor’s sole discretion. All AMOE entrants must be at least 18 years of age).

No more than one (1) entry per postcard or envelope is allowed. One entry per person is allowed during the Sweepstakes Period, November 15, 2024 – December 15, 2024. Multiple entries by any one individual may, at the sole discretion of the Sponsor, result in all of that individual’s entries being disqualified. Any attempt to violate these Official Rules will, at Sponsor’s sole discretion, result in disqualification of any or all entries submitted that are not done so in accordance with Official Rules. Any and all fees associated with the selected entry method are the sole responsibility of the individual entering the Sweepstakes.

Winner Selection and Random Drawing

Winners will be selected by random drawing at 2 p.m. on December 17, 2024, to be held at FAIRWINDS Credit Union Corporate Tower, 135 W. Central Blvd., Suite 200, Orlando, FL 32801. Winners will be randomly selected from all eligible entries received during Sweepstakes Period. Random drawing will be conducted by a representative of FAIRWINDS Credit Union, whose decisions are final on all matters relating to the Sweepstakes. {4} winners will be selected from all entrants at the end of the Sweepstakes Period.

Winner Notification and Acceptance

Winners will be notified by phone or email. Winner must respond within 48 hours of the notification. Sponsor reserves the right to use any contact phone number provided by Sweepstakes entrant to Sponsor — whether on Sweepstakes entry form, 3” x 5” index card, or in Sponsor’s current member database. Sponsor is not responsible for incomplete, inaccurate, or illegible phone numbers.

Failure to reach winner by phone or email may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of substitute winner. Winners may claim prize in person, during regular business hours, at the FAIRWINDS Credit Union Corporate Tower (135 W. Central Blvd., #200, Orlando, FL 32801), during regular business hours within fifteen (15) calendar days of being notified to claim prize. Winner may request in writing to have the prize mailed to an address of their choosing. Winners must provide a valid government-issued photo identification card when claiming prize. Winners may be required to complete and sign an affidavit of eligibility, a liability and publicity release, a W-9 form, and acceptance of these Official Rules at the time the prize is claimed. A W-9 form is required for Sponsor to issue prize winner a 1099-MISC form for the Fair Market Value of the prize, as required by the U.S. Government. Prize winner is required to provide Sponsor with all information necessary to issue a 1099-MISC form including, but not limited to, winner’s full legal name, Social Security number, and address. Winner is solely responsible for reporting and payment of any taxes on prizes. Failure of winners to sign and return any required affidavits and releases, claim prize, or comply with any term or conditions of these Official Rules, will result in winner’s disqualification and the forfeiture of his or her interest in the prize. Winner may waive the right to receive prizes. Prizes not won and not claimed by eligible winner in accordance with these Official Rules will not be awarded and will remain the property of Sponsor, or at the Sponsor’s discretion may be awarded to another randomly selected Sweepstakes entrant. Sponsor is responsible only for the issuance of prizes, not for the use, utility, and quality of prizes. Once prize is claimed, Sponsor has no further responsibility or liability, stated or otherwise implied, to winners in regards to Sweepstakes Prize.

Participation

By participating in Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor. Submission of any Sweepstakes entry constitutes entrant’s consent, without further authorization, compensation or remuneration of any kind, to the use of such person’s name, likeness, biographical information, and photograph in any and all advertising, promotions, and other publicity in any media, worldwide conducted by Sponsor.

Winners List

To obtain the list of winners, send a self-addressed, stamped envelope to: FAIRWINDS Credit Union, Debit Card Sweepstakes, 135 W. Central Blvd. #200, Orlando, FL 32801. Requests must be received by January 15, 2025. The list will be sent after selection of winners.

Dispute Resolution

Any controversy or claim arising out of or related to this Sweepstakes shall be resolved by final and binding arbitration; provided, prior to filing any arbitration, the party intending to file such a proceeding shall notify the other party in writing of the existence and the nature of the dispute. The parties each agree that within ten (10) business days of the other party's receipt of such notice, a representative of each party shall meet for a minimum of one (1) eight (8) hour day, or such shorter period of time if the dispute is more quickly resolved, in Orlando, Florida, in order to attempt to amicably resolve the dispute. If such informal dispute resolution attempts prove to be unsuccessful, the notifying party may initiate the dispute resolution procedures available as set forth herein. Each party shall bear its own costs associated with the meeting and in no event shall either party be liable to the other for any costs or expenses incurred as a result of such meeting. Except as expressly set forth below, by entering this Sweepstakes, you specifically agree to waive your right to bring a court action and have a jury trial; that any controversy or claim arising out of or related to this Sweepstakes shall be resolved by final and binding arbitration administered by the American Arbitration Association (the “AAA”) under its Consumer Arbitration Rules (the “Arbitration Rules”) in effect at the time the demand for arbitration is filed, and that there will be no class claims in arbitration. Any such controversy or claim (whether a contract, tort, statutory, or regulatory claim or claim based on any other legal theory) initiated by you or the Sponsor against the other, or against any employee, agent, or assign of the other, shall be submitted to and resolved on an individual basis by binding arbitration in accordance with the Federal Arbitration Act and the Arbitration Rules. In the event AAA determines that any provision of this Agreement does not comply with applicable standards stated in the Consumer Due Process Protocol of the National Consumer Disputes Advisory Committee, the standards of the Protocol shall control. We will tell you how to contact the AAA and how to get a copy of the Arbitration Rules without cost if you ask us in writing to do so. Alternatively, you may contact the AAA directly at 1-800-778-7879 (toll-free) or at www.adr.org. Except as otherwise set forth in the Consumer Arbitration Rules or applicable law, if you initiate a claim under the Consumer Arbitration Rules, you shall be responsible for paying a filing fee in the amount of $225. In all cases in which the Consumer Arbitration Rules apply, we shall be responsible for all administrative fees (including additional filing fees, case management fees, and hearing fees) and the compensation of the arbitrator. Arbitration claims shall be submitted and resolved on an individual basis, and the arbitrator will not consider or address class claims brought by or on behalf of other persons, or award punitive or any other monetary damages other than the prevailing party’s actual damages. The arbitration of any claim of $150,000 or greater shall be conducted by a panel of three arbitrators. The arbitration of any claim of a lesser amount shall be conducted by one arbitrator. The arbitrators shall be selected from the AAA’s national roster of arbitrators by mutual agreement between you and us. If we cannot agree on the arbitrators, the procedure for appointment from the national roster as provided by Consumer Arbitration Rules shall apply.

By entering this Sweepstakes, you agree no claim may be joined with another dispute or lawsuit, or consolidated with the arbitration of another claim, or resolved on behalf of similarly situated persons, or brought as private attorney general or on another similar representative basis. For any claim subject to arbitration, you may not participate in a class action in court or in a class-wide arbitration, either as a plaintiff or claimant, class representative or class member.

The parties acknowledge that violation of these Official Rules would cause irreparable harm that would not be adequately compensable by monetary damages. In addition to other relief, it is agreed that preliminary and permanent injunctive relief will be available to prevent any actual or threatened violation of such provisions.
